Tennessee hemp law in 2026, and what it means at our Cool Springs store

On January 1, 2026, Tennessee’s Public Chapter 526 moved hemp-derived cannabinoid products under the Tennessee Alcoholic Beverage Commission (TABC) and changed what a store in this state may sell. This is what changed, what you can still buy at our Cool Springs store in Franklin, and where to read the rules for yourself.

Is THC legal in Tennessee in 2026?

Hemp-derived delta-9 THC products that meet Tennessee’s limits are legal for adults 21 and over, bought in person from a retailer licensed by the Tennessee Alcoholic Beverage Commission. Marijuana is not legal in Tennessee.

Is delta-8 legal in Tennessee?

No, not since January 1, 2026. Public Chapter 526 treats delta-8 THC as a synthetic cannabinoid, and the TABC does not permit synthetic cannabinoids in any amount.

Can I still buy THCA flower in Tennessee?

Generally not. Tennessee now counts THCA toward total THC, using total THC = (THCA × 0.877) + delta-9 THC. THCA flower usually tests far above the 0.3% limit once it is counted that way, so it no longer qualifies as hemp.

Is THCp legal in Tennessee?

No. The TABC states that hemp-derived cannabinoid products may not contain THCp in any amount.

Can I order hemp or THC products online in Tennessee?

No. TABC-licensed retailers may not deliver or ship hemp-derived cannabinoid products to customers, directly or indirectly. Our website is a catalog: you can browse everything here, then buy at the counter.

Do I need ID to buy hemp products?

Yes. You must be 21 or older, and we check photo ID for every purchase, including drinks and topicals.
